GENERAL TERMS​

• This process entails a virtual transaction between the Client (you) and the Artist (Kestrelia) for a digital art product.

• The Client must provide visual references for all services requested. A full-body reference and/or clear concept work must be provided for 3D model commissions.

• Unless otherwise agreed upon, orders will be completed within 1-12 weeks of accepting initial sketch, based on complexity.

• All commission inquiries will place Client on a waitlist until Artist is able to begin working on their commission(s). Client will be moved into the main queue once appropriate payment has been made.

• All commission-related conversations shall be done via email and/or Discord.

• Artist's works must always be credited where used (@kestrelia_) unless a permanent NDA is purchased.

• Artist's works must NEVER be traced, used for AI learning, or NFT/blockchain distribution.

• You may not edit delivered products without knowledge and permission of Artist. Please speak to her directly if you require changes.

• Artist reserves the right to refuse commissions for content including but not limited to: NSFW, excessive violence/gore, works that exceed the scope of artist capability, disrespectful behavior presented by the Client, etc.

COPYRIGHT & USAGE​

• Artist retains the commercial right to use commissioned works for self-promotion, merchandise, and to work on said works during public livestreams.

• If Client wishes to request an NDA (non-disclosure agreement) there will be a 10% fee. Artist will not post Client's order progress on any social media until after Client's specified date. This request must be indicated beforehand.

  • A permanent NDA will be 4x the total price and must be indicated beforehand. This will provide Client with an exclusively commercially-licensed, unwatermarked and editable finished piece which Artist will not showcase on any of her platforms. Project will not be used by Artist hereafter and no credit will be required.

• Commercial-use licenses will be 2x the total price and must be indicated beforehand. Credit will still be required.

• Unless otherwise stated, by default, all commissions are only permitted for personal non-commercial use. This means that Client shall:

  • NOT use the copyrighted artwork commercially (make money of it in any way such as streaming, merchandise, album covers, monetized social media, public flyers, etc.)

  • NOT claim credit for the creation of the commissioned artwork, alter the artwork without written permission, or remove watermarks.

PAYMENT & REFUNDS​

• Please do NOT make payments until Artist asks you to, after consultation. Artist will begin working on Client's piece after discussed payment is made.

• All payments must be made in USD using Paypal.

• There will be a 20% fee for all rush orders. This means Client will bypass Artist's waitlist and receive their completed commission in priority sequence based on specified date of delivery.

• Payment Plans

  • Client has the option to pay 100% fees upfront, or to split into 2 payments. Please indicate preference beforehand.

  • Illustrations / Sketches

    • ​For orders at/under $50, upfront payment is required.

    • For orders above $51, Client has option to pay 50% upfront and 50% after sketch is complete.

  • VRoid Models / Assets

    • For models, Client has option to pay 50% upfront and 50% before Artist begins rendering clothes.​

    • For standalone 3D assets (accessories, hairstyles, particles), upfront payment is required.

• Refunds

  • 90% refund is available if Artist has not started Client's order yet.

  • 40% refund is available if Artist has begun Client's order.

  • No refunds are available after sketch is approved.

• Chargebacks will not be tolerated. Please be civil and keep communications open if you have concerns at any time during your order.​
